The unanimous decision speaks volumes about the city’s commitment to providing a framework that will allow for regulated cannabis cultivation, processing, and dispensary operations in Bowling Green. This ordinance lays down the foundation for a structured licensing process that those interested in entering the cannabis business will need to follow.

Why Local Control Matters

City Manager Jeff Meisel highlighted an important aspect of this ordinance: local control. With uncertainties looming over state enforcement regarding cannabis laws, the city understood that taking charge locally would provide clarity and direction for everyone involved. This is especially vital considering that Kentucky went ahead and legalized medicinal marijuana back in April 2023. The recent legislation allows individuals suffering from specific illnesses to apply for a medical cannabis card.

The list of approved ailments that qualify for medical cannabis includes, but is not limited to, cancer, PTSD, multiple sclerosis, and chronic severe pain—conditions known to be alleviated by marijuana. While some municipalities had the option to “opt-out” of the new law, Bowling Green unintentionally opted in as of January 1, 2025, which means it is all hands on deck as the city prepares to support medicinal cannabis.

Understanding the Licensing Process

Having already amended zoning regulations for dispensaries, the city requires that they be located in “highway business” zones, at least 1,000 feet away from schools, and spaced at a distance of at least one mile apart. This thoughtful planning is crucial for maintaining the integrity of the community while also ensuring that those who may benefit from cannabis can access it.

City Attorney Hillary Hightower noted that crafting this ordinance wasn’t done in isolation. Collaboration with other city attorneys across the state played a pivotal role in shaping a robust regulatory framework that locals can trust.
